Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you ("you" or "User") and FixerLog, LLC, a New Hampshire limited liability company ("FixerLog," "we," "us," or "our"), governing your access to and use of the FixerLog mobile application and related services (collectively, the "Service"). By downloading, installing, creating an account, or otherwise using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.


1. Eligibility

You must be at least thirteen (13) years of age to use the Service. If you are between the ages of 13 and 18, you represent that your parent or legal guardian has reviewed and consents to these Terms on your behalf. You represent that you have the legal capacity to enter into a binding agreement under the laws of your jurisdiction. We reserve the right to request proof of age or parental consent at any time and to suspend accounts where eligibility cannot be verified.


2. Account Registration and Security

To access certain features of the Service, you must create an account. You agree to:

We reserve the right to refuse registration, suspend, or terminate accounts at our discretion, including where we have reason to believe that account information is inaccurate, that the account is being used in violation of these Terms, or that the account poses a security risk.

You agree to use the Service only for lawful purposes and in compliance with these Terms. You agree that you will not:

We reserve the right to investigate suspected violations and to take appropriate action, including suspension or termination of your account and, where appropriate, referral to law enforcement.


5. Free Tier and Usage Limits

The free tier of the Service is available at no charge and is subject to usage limitations. These limitations may include restrictions on the number of appliances you may track, the number of AI chat interactions available per billing period, and the total storage available for photos. Current free tier limits are described within the app.

We may modify free tier limits at any time. We will provide reasonable notice of changes to free tier limits through the app. Continued use of the Service after any modification constitutes your acceptance of the updated limits.

The free tier is provided without a service level commitment. We will make commercially reasonable efforts to maintain availability but do not guarantee uptime or response times for free tier accounts.


6. FixerLog Pro Subscription

6.1 Subscription Terms

FixerLog Pro is a paid subscription that provides access to enhanced features and higher usage limits, as described within the app at the time of purchase. By subscribing, you authorize FixerLog to charge the applicable subscription fee to your designated payment method on a recurring basis (monthly or annually, as selected by you). Subscription fees are stated in U.S. dollars at the time of purchase.

6.2 Billing and Payment

Payment is processed by Stripe, Inc. Your payment information is collected and handled by Stripe in accordance with Stripe's terms of service and privacy policy. By providing a payment method, you represent and warrant that you are authorized to use that payment method and you authorize FixerLog to charge the applicable fees to it.

If a payment fails, we may retry the charge and/or suspend access to Pro features until payment is successfully processed. We will notify you of payment failures by email.

6.3 Price Changes

We reserve the right to change subscription pricing. If we increase the price of your current plan, we will provide at least thirty (30) days' advance notice by email. The new price will take effect at the start of your next billing period following the notice period. If you do not agree to the price change, you may cancel your subscription before the new price takes effect.

6.4 Renewal and Cancellation

Subscriptions renew automatically at the end of each billing period unless canceled before the renewal date.

How to cancel: To cancel your subscription, send an email to info@fixerlog.com with the subject line "Cancel Pro Subscription" and include the email address associated with your account. We will process your cancellation request within two (2) business days and confirm by email. Cancellation takes effect at the end of your current billing period. You will retain access to Pro features until that date.

We do not provide prorated refunds for unused portions of a billing period, except where required by applicable law.

6.5 Free Trials

If we offer a free trial of FixerLog Pro, the following terms apply: (a) the trial period and its terms will be disclosed to you before you enroll; (b) the trial will automatically convert to a paid subscription at the standard rate at the end of the trial period unless you cancel before the trial ends; (c) we will notify you before your payment method is charged for the first paid billing period.

6.6 Taxes

Subscription prices do not include applicable sales, use, value-added, goods and services, or similar taxes. You are responsible for paying all such taxes imposed in connection with your subscription, except for taxes based on FixerLog's net income.


7. AI Assistant — Limitations and Disclaimer

The FixerLog AI assistant is powered by Anthropic, Inc.'s Claude API, a third-party large language model service. The AI assistant is provided strictly as an informational tool to help you research, organize, and reason about questions related to your home appliances and their maintenance.

THE AI ASSISTANT DOES NOT PROVIDE PROFESSIONAL REPAIR, MAINTENANCE, ENGINEERING, ELECTRICAL, PLUMBING, HVAC, OR SAFETY ADVICE. AI RESPONSES ARE GENERATED BY A MACHINE LEARNING MODEL AND ARE NOT REVIEWED, VERIFIED, OR ENDORSED BY FIXERLOG. THEY ARE NOT A SUBSTITUTE FOR THE JUDGMENT OF A LICENSED TECHNICIAN, QUALIFIED SERVICE PROFESSIONAL, OR OTHER RELEVANT EXPERT.

By using the AI assistant, you expressly acknowledge and agree that:

  1. AI-generated responses may contain factual errors, omissions, hallucinations, outdated information, or content that is inapplicable to your specific appliance, model, configuration, or situation;
  2. You will exercise your own judgment and will not rely on AI assistant responses as the sole or primary basis for any repair, maintenance, modification, or safety decision involving your home appliances, systems, or property;
  3. Any action you take based on or informed by AI assistant responses is taken entirely at your own risk;
  4. FixerLog does not independently verify the accuracy, completeness, or applicability of any individual AI-generated response;
  5. The AI assistant has no awareness of your appliance's actual physical condition, your skill level or experience, applicable local building codes or regulations, or manufacturer-specific safety requirements, except to the extent you provide such information in your messages;
  6. The AI assistant may produce different responses to the same question at different times, and neither response is guaranteed to be correct.

When in doubt, consult a licensed professional. FixerLog helps you organize your records and your thinking — it does not replace the person who actually knows how to safely service your equipment.


8. User Content

8.1 Ownership

You retain all ownership rights in content you submit to the Service, including photographs, appliance records, notes, and chat messages (collectively, "User Content"). FixerLog does not claim ownership of your User Content.

8.2 License Grant

By submitting User Content to the Service, you grant FixerLog a non-exclusive, royalty-free, worldwide, sublicensable (solely to our service providers as necessary to operate the Service) license to store, reproduce, display, transmit, and process your User Content solely as necessary to:

This license terminates when you delete your User Content or your account, subject to the retention periods described in our Privacy Policy and any legal obligations to retain data.

8.3 Content Responsibility

You are solely responsible for your User Content. You represent and warrant that: (a) you own or have the necessary rights and permissions to submit your User Content; (b) your User Content does not infringe or misappropriate any third party's intellectual property, privacy, or other rights; and (c) your User Content complies with these Terms and all applicable laws.

8.4 Prohibited Content

You agree not to submit User Content that:

We reserve the right, but have no obligation, to review, monitor, or remove User Content that we determine violates these Terms, in our sole discretion.


9. Intellectual Property

The Service, including its software, design, user interface, logos, trademarks, service marks, and all other content and materials (excluding User Content), is owned by or licensed to FixerLog, LLC and is protected by copyright, trademark, patent, trade secret, and other applicable intellectual property laws of the United States and other jurisdictions.

These Terms grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service for your personal, non-commercial purposes in accordance with these Terms. All rights not expressly granted are reserved by FixerLog.


10. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, store, and share your information. The Privacy Policy is incorporated into these Terms by reference. By using the Service, you acknowledge that you have read and understood our Privacy Policy.


11. Third-Party Services

The Service integrates with or relies upon third-party services, including:

Your interactions with these third-party services may be subject to their respective terms of service and privacy policies, which are independent of these Terms. FixerLog is not responsible for the availability, accuracy, or practices of any third-party service. Your sole remedy for any issue arising from a third-party service is with that third-party provider.


12. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, FIXERLOG DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM FIXERLOG OR THROUGH THE SERVICE SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS.


13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW:

13.1 FIXERLOG, ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, AGENTS, SUPPLIERS, AND LICENSORS (COLLECTIVELY, THE "FIXERLOG PARTIES") SHALL NOT BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, USE, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO: (A) YOUR ACCESS TO, USE OF, OR INABILITY TO USE THE SERVICE; (B) ANY CONTENT OR CONDUCT OF ANY THIRD PARTY ON OR THROUGH THE SERVICE; (C) ANY AI-GENERATED CONTENT OR YOUR RELIANCE ON SUCH CONTENT; (D) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA; OR (E) ANY OTHER MATTER RELATING TO THE SERVICE — REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE) AND EVEN IF ANY FIXERLOG PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

13.2 IN NO EVENT SHALL THE FIXERLOG PARTIES' TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE EXCEED THE GREATER OF: (A) THE TOTAL AMOUNTS ACTUALLY PAID BY YOU TO FIXERLOG IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM; OR (B) ONE HUNDRED U.S. DOLLARS ($100.00).

13.3 THE LIMITATIONS IN THIS SECTION APPLY TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IN SUCH JURISDICTIONS, OUR LIABILITY IS LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.


14. Indemnification

You agree to indemnify, defend, and hold harmless the FixerLog Parties from and against any and all claims, demands, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees and court costs) arising out of or relating to: (a) your access to or use of the Service; (b) your User Content; (c) your violation of these Terms; (d) your violation of any applicable law, rule, or regulation; or (e) your violation of any rights of a third party. FixerLog reserves the right, at your expense, to assume the exclusive defense and control of any matter subject to indemnification by you, and you agree to cooperate with our defense of such claims. This indemnification obligation will survive termination of these Terms and your use of the Service.


15. Account Suspension and Termination

15.1 Termination by You

You may terminate your account at any time by contacting us at info@fixerlog.com or, if available, by using the account deletion feature within the app. Termination does not entitle you to a refund of any prepaid subscription fees, except as required by applicable law.

15.2 Termination or Suspension by FixerLog

We reserve the right to suspend or terminate your access to the Service, with or without prior notice, if we determine in our sole discretion that:

Where practicable, we will provide notice of termination and an opportunity to export your data before your account is deleted. In cases of suspected fraud, abuse, or legal necessity, we may suspend or terminate access without prior notice.

15.3 Effect of Termination

Upon termination of your account:

16. Governing Law and Dispute Resolution

16.1 Governing Law

These Terms are governed by and construed in accordance with the laws of the State of New Hampshire, United States, without regard to its conflict of laws provisions.

16.2 Informal Resolution

Before initiating any formal legal proceeding, you and FixerLog agree to attempt to resolve any dispute informally by contacting us at info@fixerlog.com and describing the dispute. We will attempt to resolve the dispute through good-faith negotiation for a period of at least thirty (30) days from the date of your notice.

16.3 Jurisdiction and Venue

Any dispute that cannot be resolved informally shall be resolved exclusively in the state or federal courts located in the State of New Hampshire, and you irrevocably consent to the personal jurisdiction and venue of such courts.

16.4 Class Action Waiver

TO THE EXTENT PERMITTED BY APPLICABLE LAW, YOU AND FIXERLOG AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. Unless both you and FixerLog agree otherwise in writing, no arbitrator or judge may consolidate more than one person's claims or otherwise preside over any form of representative or class proceeding.


17. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make changes, we will revise the "Last Updated" date at the top of this document. If we make material changes, we will provide notice by email (to the address associated with your account) or through a prominent notice within the app at least thirty (30) days before the changes take effect. Your continued use of the Service after the effective date of the updated Terms constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must stop using the Service and may terminate your account.
